
Portrait Photography Terms & Conditions - Russell Lewis Photography

These Terms & Conditions apply to all portrait photography services provided by Russell Lewis Photography (“the Photographer”) to the individual commissioning the work (“the Client”).
1. DEFINITIONS

“Photographer” means Russell Lewis Photography

“Client” means the person booking the portrait session.

“Images” means all photographs taken during the session.

“Session” means the photography shoot or event covered.
2. BOOKING & PAYMENT
2.1 A booking is confirmed only once the Photographer receives written acceptance of these terms and the required booking fee. 2.2 A 50% non-refundable booking fee is required to secure the date.
2.3 The remaining balance is payable 3 days prior to the session. Images will not be released until full payment is cleared.
3. CANCELLATION & POSTPONEMENT
3.1 If the Client cancels the booking, the booking fee is forfeited.
3.2 Cancellations made within 48 hours of the session may incur the full session fee.
3.3 If the Client needs to postpone due to illness or emergency, the booking fee may be transferred to a new date at the Photographer’s discretion, subject to availability.
3.4 In the event of adverse weather (for outdoor sessions), the Photographer reserves the right to postpone the session to the next available date at no additional cost to the Client.
4. CREATIVE DIRECTION & DELIVERY
4.1 The Photographer retains full creative control regarding the choice of locations, poses, and post-production editing style.
4.2 The Photographer will deliver a curated selection of final edited Images. The final number of images depends on the nature of the session and is at the Photographer’s professional discretion.
4.3 Standard delivery for the digital gallery is 1 week from the session date.
4.4 RAW or unedited files are not available for viewing or purchase.
5. COPYRIGHT & PERSONAL USAGE
5.1 All copyright in the Images remains the property of the Photographer under the Copyright, Designs and Patents Act 1988.
5.2 The Client is granted a licence for Personal Use only. This includes:

Printing for personal display or gifts.

Sharing on personal social media profiles.

Using as personal avatars or profile pictures.
5.3 The Client may not use the Images for commercial purposes, enter them into competitions, or sell them to third parties without prior written consent from the Photographer.
6. PHOTOGRAPHER’S USE OF IMAGES
6.1 Unless otherwise requested in writing, the Photographer may use the Images for the purposes of self-promotion, including website galleries, social media, and portfolio displays.
6.2 If the Client wishes for the Images to remain private, this must be confirmed at the time of booking.
7. ALTERATION OF IMAGES
The Client shall not apply digital filters or otherwise edit, crop, or alter the Images in a way that changes the Photographer's original work when sharing the Images publicly.
8. COOPERATION & CONDUCT
8.1 The Photographer is not responsible for a lack of coverage caused by the Client’s lateness or the uncooperative behavior of subjects (e.g., children).
8.2 If the Client is more than 30 minutes late, the Photographer reserves the right to cancel the session, and all fees paid will be forfeited.
9. STORAGE & ARCHIVING
9.1 Final Images will be archived for 1 year from the delivery date.
9.2 It is the Client’s responsibility to download and back up their Images. The Photographer is not liable for data loss once the Images have been delivered.
10. LIMITATION OF LIABILITY
10.1 In the unlikely event of equipment failure, data loss, or illness, the Photographer’s liability is limited to a refund of the fees paid for the session.
10.2 The Photographer is not liable for any personal injury or damage to personal property during the session, except where caused by the Photographer’s direct negligence.
11. DATA PROTECTION
Personal data provided by the Client will be processed in accordance with UK GDPR and used only for the administration of the booking and delivery of the Images.
12. GOVERNING LAW
These Terms & Conditions are governed by the laws of England and Wales.
13. LOCATION FEES & PERMISSIONS
13.1 If the Client requests a session at a location that requires a permit, booking fee, or professional photography "sitter fee," the Client is solely responsible for these costs.
13.2 In the first instance, the Client is responsible for contacting the venue to confirm their photography policy and securing the necessary permissions for the date and time of the Session.
13.3 Any fees must be paid directly by the Client to the venue or reimbursed to the Photographer prior to the session, as agreed in writing.
13.4 The Photographer is not liable for any Session delays or cancellations resulting from the Client’s failure to secure the necessary permits or pay location-specific fees. In such cases, the cancellation terms in Clause 3 will apply.
